Scope and our commitment
The Marketing Room (we, us or our) respects your privacy. We manage personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) where they apply to us.
This policy applies to information we handle through this website, our business operations, client and supplier relationships, recruitment, and communications. It does not govern third-party websites linked from our site.
“Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable. You can read the Australian Privacy Principles on the Office of the Australian Information Commissioner (OAIC) website.
Information we collect and hold
Depending on how you deal with us, we may collect:
- identity and contact details, such as your name, email address and phone number;
- your employer, role, location and professional or business interests;
- enquiry details, correspondence, meeting notes and service preferences;
- recruitment information, including your work history, LinkedIn profile, CV, preferred role, location and anything you choose to include in an application;
- client, supplier and contractor records needed to manage our relationships;
- technical information such as IP address, device and browser details, pages visited, referral source and website interaction data; and
- marketing preferences and records of consent or unsubscribe requests.
Please do not provide sensitive information unless it is reasonably necessary and we have requested it or you consent to us handling it. If you provide information about another person, you should be authorised to do so and make them aware of this policy.
How we collect information
We usually collect information directly from you when you contact us, submit a job application, communicate with our team, attend an event, subscribe to a communication, or engage us to provide services. Our contact form opens your email application; the information is sent only when you choose to send that email.
We may also receive information from your organisation, referees or recruitment sources, professional networks, service providers, public sources, and people who introduce you to us. We may collect technical information automatically when you use our website.
Where practicable, you may deal with us anonymously or using a pseudonym. This may not be possible when we need to identify you to respond, contract with you, or assess an application.
How we use information
We collect, hold, use and disclose personal information where reasonably necessary to:
- respond to enquiries and provide, improve and administer our services;
- manage client, adviser, contractor, supplier and other business relationships;
- assess job applications, contact candidates and manage recruitment;
- operate, secure, measure and improve our website and business systems;
- send relevant business updates and marketing where permitted;
- meet legal, regulatory, insurance and professional obligations; and
- prevent or investigate suspected fraud, misuse, security incidents or unlawful activity.
We may also use information for another purpose where you have consented, where you would reasonably expect it and the law permits it, or where required or authorised by law.
Artificial intelligence and responsible use
We may use approved artificial intelligence (AI) tools to assist with activities such as research, analysis, summarisation, drafting, quality assurance and routine administration. Personal information entered into, inferred by or produced by an AI system remains subject to this policy and applicable privacy law.
When AI is used, our approach is to:
- use only the information reasonably necessary for a defined and legitimate purpose;
- avoid entering sensitive or confidential information into public AI tools;
- assess providers, access controls, security, retention and potential overseas handling;
- review material outputs for accuracy, bias, fairness and suitability;
- maintain meaningful human oversight and accountability; and
- be transparent where AI use could reasonably matter to an individual.
We do not use personal information to train our own general-purpose AI models. We do not currently use solely automated decision-making to make decisions that have a significant effect on an individual’s rights or interests. If that changes, we will update this policy and provide the transparency required by law.
Our approach is informed by the OAIC’s privacy guidance for commercial AI and Australia’s voluntary AI Ethics Principles, including fairness, privacy, security, reliability, transparency and accountability.
Direct marketing
We may send you relevant news, insights or service information where you have consented or where the law otherwise permits. Every commercial electronic message will identify us and provide a simple way to unsubscribe. You can also opt out at any time by contacting us. We will action requests within the period required by law and will not charge you for opting out.
If we obtained your details from a third party, you may ask us to identify the source where the law requires us to do so.
Website data, cookies and external links
Our website and service providers may use essential cookies and similar technologies to operate securely, remember settings, understand aggregate usage and improve performance. If we introduce non-essential advertising or behavioural tracking, we will provide appropriate notice and choices.
You can control cookies through your browser, although blocking essential cookies may affect website functionality. Our site may link to third-party websites and social platforms. Their privacy practices are governed by their own policies, not this one.
Overseas handling
We operate across Australia, New Zealand, Singapore, the United Kingdom, Ireland and the United States. Personal information may be accessed from those locations when needed to deliver services or manage our operations. Some technology and cloud providers may also store or process information overseas, and their locations can change.
Where Australian privacy law applies, we take reasonable steps before disclosing personal information overseas to require appropriate privacy and security protections, subject to the exceptions in the Privacy Act. Contact us if you would like current information about likely overseas locations relevant to your data.
Security, retention and data breaches
We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. These measures may include access restrictions, secure storage, authentication, staff processes, provider reviews and incident response controls. No online system is completely secure.
We retain personal information only for as long as reasonably needed for the purpose collected and any legal, accounting, insurance or dispute requirements. When it is no longer required, we take reasonable steps to destroy it or permanently de-identify it. Recruitment records may be retained to consider you for future opportunities unless you ask us not to.
We maintain procedures for responding to suspected data breaches. If a breach is likely to result in serious harm, we will notify affected people and the OAIC as required under the Notifiable Data Breaches scheme.
Access and correction
You may ask to access personal information we hold about you or request a correction if it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact our privacy contact below and provide enough detail for us to identify the information. We may need to verify your identity first.
We will respond within a reasonable period. If the law permits or requires us to refuse a request, we will generally explain why and tell you how to complain. We do not charge for making a request, although we may charge reasonable access costs where permitted and advised in advance.
Privacy complaints
If you have a privacy concern or complaint, email jon@themarketingroom.com.au. Please describe what happened and the outcome you are seeking. We will acknowledge your complaint and investigate it fairly, aiming to respond within 30 days. We will tell you if we need more time.
If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner. The OAIC generally expects you to raise the matter with us first.
Changes and contact
We may update this policy when our practices, technology or legal obligations change. The current version will be published here with a revised effective date. Material changes will be communicated where appropriate.
